BianchiSchwald wins patent infringement case regarding flow sensors before Swiss Federal Patent Court

On December 18, 2018, the Swiss Federal Patent Court decided an almost three years lasting patent law dispute in favor of BianchiSchwald's Swiss client Hamilton Medical AG (“Hamilton”), represented by its partner Christoph Gasser, against its Swiss opponent imtmedical AG (“IMT”). The court ruled that IMT has infringed Hamilton’s Patent CH 701 755 B1 regarding flow sensors, in particular, proximal flow sensors, and approved Hamilton’s claim for injunction, destruction, and disclosure of business data. The decision is still subject to appeal. Hamilton’s claim for monetary compensation against IMT will part of the second stage of the proceeding.
